Texas Lawsuit Focuses on Dangerous Daycare Loophole

Texas child injury lawyers filed a lawsuit against Woodbridge Day school alleging that two-year-old Isabella Estep died after ingesting a rock in a school classroom in 2008 after her teacher failed to treat her while she was on the floor and was dying.

It is believed that the lawsuit may help to close a loophole in Texas daycare licensing that removes all references to deficiencies and violations by the Texas Department of Family and Protective Services if a daycare facility is sold.  An investigation by the Department found that the teacher and owner of the Neyse Hall were not trained in first aid training in violation of Texas state law.

During the investigation, the owner of the daycare school made comments to the licensing investigator that she hoped that the investigator’s “legs would be broken so that she would never have to see the investigator again.”  The investigation also turned up 20 other deficiencies at the daycare school.
